1. Adults only

You must be at least 18 years old and legally able to enter a contract in your location to use the store, submit a request, or purchase anything. By entering or ordering, you confirm that you meet these requirements.

2. Brand ownership and licensed store operation

Ngansturr is independently owned by its creator. The brand owner has granted Incendiary Media a limited license to use the Ngansturr name, approved likeness, and approved creative materials solely to build, market, operate, and administer this store and its related customer workflows. Incendiary Media does not own the Ngansturr brand or creative identity.

Incendiary Media acts as the store administrator and merchant for purchases processed through this site, including payment, tax, order, shipping, and customer-service administration. Charges, receipts, or tax records may therefore identify Incendiary Media or a payment provider acting on its behalf.

3. Product nature and made-to-order preparation

Worn-to-order items are prepared specifically for the purchasing customer after an order is accepted. The selected item is worn for the duration and according to the preferences shown in the confirmed order. These products are personal, made to order, sold as-is, and may be shipped unwashed when that is the stated product configuration. Natural differences in appearance, scent, wear, packaging, and fit are expected and are not defects.

Product photographs may be representative. Footwear styles, sizes, colors, and individual pieces depend on availability and will be confirmed when needed before preparation begins.

4. Custom content and personalized work

A custom request is not accepted until the concept, price, delivery format, timing, and any limitations are confirmed in writing. Incendiary Media may decline any request at its discretion. Changes requested after production begins may require an additional fee or may not be possible.

5. Orders and payment

Adding an item to a bag or sending a request does not guarantee availability. An order becomes binding only after Incendiary Media confirms it and payment is successfully completed. Prices are shown in U.S. dollars. Applicable sales tax, shipping, customs duties, and other charges are added when required. We may correct pricing or listing errors before accepting an order.

Payments must be made through the checkout or payment method provided for the order. Customers must not send payment through an unrelated or unapproved channel.

6. Shipping and delivery

The customer pays shipping unless a listing expressly says otherwise. Rates are based on package size, estimated weight, destination, and carrier service. Orders are packaged discreetly and may be double-bagged where appropriate. Customs forms, carriers, or applicable law may still require accurate sender, recipient, value, and product information.

We will provide a reasonable shipment estimate when the order is confirmed. If no timeframe is stated, we will ship within 30 days or contact you for consent to a delay and provide any cancellation or refund rights required by law. Delivery dates are estimates; carrier delays after acceptance are outside our direct control. Customers are responsible for providing a complete, accurate, and deliverable address.

International customers are responsible for customs duties, import taxes, and determining whether an item may lawfully be imported into their location. We may refuse destinations or orders that create legal, carrier, safety, or customs concerns.

7. Final sales, cancellations, and problems

Because worn-to-order, personalized, and custom items are prepared for one customer, sales are final once preparation or production begins. Before that point, cancellation requests will be considered but are not guaranteed. Digital content is final once delivered or accessed.

This policy does not limit rights that cannot legally be waived. If an item is damaged in transit, materially different from the confirmed order, or the wrong item was sent, email hello@ngansturr.com within seven days of delivery with the order number and clear photographs so we can review the issue.

8. Customer conduct

Customers must communicate respectfully and may not submit unlawful, threatening, exploitative, harassing, fraudulent, or non-consensual requests. Attempts to reverse payment dishonestly, misuse personal information, redistribute private content without permission, or evade these terms may result in cancellation, account restriction, or other lawful action.

9. Content and intellectual property

The Ngansturr name, brand identity, approved likeness, and creator-owned photographs, videos, and custom content remain the property of the Ngansturr brand owner. Incendiary Media uses those materials under a limited license and retains rights in the store systems, workflows, and original operational materials it provides, subject to its private agreement with the brand owner. A customer purchase does not transfer ownership of any brand or intellectual-property rights. Unless written permission says otherwise, customers may not reproduce, resell, publish, distribute, or commercially exploit site or custom content.

10. Third-party services and links

Checkout, shipping, social platforms, and external links may be operated by third parties with their own terms and privacy practices. Incendiary Media is not responsible for third-party sites or services that it does not control.

11. Disclaimers and liability

To the fullest extent permitted by law, the site and products are provided “as is” and “as available,” without warranties beyond those expressly stated in writing. Incendiary Media is not liable for indirect, incidental, special, or consequential losses arising from use of the site, carrier delays, third-party services, or misuse of a product. Any liability that cannot be excluded is limited to the amount paid for the affected order, except where applicable law requires otherwise.

12. Governing law and changes

These terms are governed by Florida law, without regard to conflict-of-law rules. Any dispute not resolved informally will be handled by a court with jurisdiction in Lee County, Florida, unless applicable consumer law requires another forum. We may update these terms for future use of the site. The effective date above identifies the latest version.
